1. About these terms
These terms apply when you use thrivingera.com and its related pages, take the free Founder Systems Diagnostic, the free AI-Native Audit or the free Founder Quiz.
They are an agreement between you and Thriving Era Ltd, a company incorporated in England & Wales (company number 16618356), registered office 85 Macers Court, Broxbourne, England EN10 6ED, trading as Thriving Era Studio ("we", "us").
Rochelle ("Rocha") Livingstone runs Thriving Era Studio.
By using the site, the diagnostic, the audit or the quiz, you agree to these terms.
Our Privacy Notice (thrivingera.com/privacy) explains how we handle your information.
Other Thriving Era Studio products and services may have their own terms.
If they do, those terms apply to them.
Nothing in these terms removes rights you have under consumer law that cannot be excluded.
That includes the consumer guarantees under the Australian Consumer Law and your statutory rights in the UK and EU.
2. Using the site
- Use the site lawfully and only for its intended purpose.
- Do not try to break, overload, scrape or get around the security of the site or the audit.
- Do not share your private audit link publicly. Anyone with the link can open your audit and report.
- We may change, pause or remove parts of the site at any time.
3. The free Founder Systems Diagnostic
- The diagnostic is free.
- Your results are generated automatically from your own answers.
- They are general information to help you reflect on your business. They are not business, financial, legal or tax advice.
- Time and hour estimates are estimates, not measurements or promises.
- We may limit how often the diagnostic can be taken from one email or connection.
4. The AI-Native Audit
What it is
- A free online audit of how your business runs, and where AI could take over repeated work. It takes about ten minutes.
- Your report on screen when you finish, and a copy by email.
- The offer of a free 20-minute exploratory call with Rocha, booked through Calendly.
How it works
- You give your name, email and a few details about your business, and start the audit.
- We email you a private link, so you can come back to it on any device.
- You answer the questions. One audit per start.
- Your report appears on screen and is emailed to you.
- If you would like to, you book an exploratory call.
We may limit how many audits can be started from one email address or connection.
What you need to do
- Give honest, accurate answers. The report is only as good as what goes in.
- Keep your private link to yourself.
- Only include information you are allowed to share.
Estimates are estimates
Your report includes figures such as hours wasted, hours AI could replace, money wasted and revenue.
These are estimates calculated from your own answers, using general assumptions.
They are not an audit of your accounts, and they are not a guarantee of savings, time back or revenue.
Results depend on your business, your choices and how any recommendations are put into practice.
The report and call are general guidance on using AI in your business.
They are not financial, legal, tax, employment or data-protection advice.
Get professional advice before relying on them for those matters.
5. Intellectual property
The site, the diagnostic, the audit, the questions, scoring, frameworks, report design and wording belong to us or our licensors.
Your answers belong to you.
You give us permission to use them to create your report, deliver the audit and call, and as described in our Privacy Notice.
We may use anonymised, combined data, never identifying you or your business, to improve the audit.
Your report is yours to keep and use.
You are free to act on it yourself, share it with your team and advisers, or take it to another provider, whether or not you go ahead with the 7-day build.
Please do not resell the audit itself, publish the question set, or use our materials to build a competing product.
We will not publish your answers, name or results without your written permission.
6. Our liability
We provide the site, the diagnostic and the audit with reasonable care and skill.
Apart from that, and as far as the law allows, they are provided "as is".
As far as the law allows:
- we are not liable for indirect or consequential loss, or for lost profits, revenue, savings or opportunity, arising from the site, the diagnostic or the audit;
- our total liability for the free audit, the free diagnostic and the site is limited to £100.
Where the Australian Consumer Law allows us to limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the service again or paying the cost of having it supplied again.
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law.
UK and EU consumers keep their statutory rights.
7. Things outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, such as outages at our providers (Vercel, Supabase, Resend, Calendly).
If this happens, we will deliver as soon as we reasonably can.
8. Changes to these terms
We may update these terms and will show the new date at the top.
The terms in place when you took the audit apply to that audit.
9. Governing law
These terms are governed by the laws of England & Wales.
The courts of England & Wales have non-exclusive jurisdiction.
If you are a consumer living in the UK or EU, you also keep the protection of the laws and courts of the country where you live.
10. General
- If any part of these terms cannot be enforced, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- You may not transfer your rights under these terms. We may transfer ours to a business that takes over Thriving Era Studio, without reducing your rights.
